Musthave Babe

Article 1 – Definitions

In these terms and conditions, the following definitions apply: the withdrawal period, the consumer, the day, the duration transaction, the durable data carrier, the right of withdrawal, the entrepreneur, the distance contract, and the technology for distance communication, as defined in applicable laws and regulations.

Article 3 – Applicability

These terms and conditions apply to every offer, order, and distance contract between Musthave Babe and the consumer.

 

Article 4 – The Offer

All offers made by Musthave Babe are non-binding. Product images aim to represent the items as accurately as possible; however, minor variations in color or shape may occur. Obvious errors or mistakes in the offer are not binding.

 

Article 5 – The Agreement

The agreement is concluded once the offer has been accepted. Musthave Babe confirms orders electronically and provides secure payment methods. Orders may be refused for justified reasons.

 

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 14 days of receiving the order, without stating a reason. Products must be returned unused and in their original condition.

Worn or unsealed jewelry and earrings cannot be returned for hygiene reasons.

 

Article 7 – Costs in Case of Withdrawal

The costs of returning goods are borne by the consumer. Refunds will be processed within 14 days after receipt of the returned product.

 

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that are custom-made, sealed for hygiene reasons (such as earrings), or perishable.

 

Article 9 – Prices

All prices include VAT. Prices may be adjusted in case of changes in VAT rates or legal regulations.

 

Article 10 – Warranty

Musthave Babe offers a 24-hour warranty on material and manufacturing defects (excluding normal wear and tear). Defects must be reported within 24 hours. The warranty is void in cases of improper use, damage caused by the customer, or modifications to the product.

 

Article 11 – Delivery

Orders are dispatched within 1 business day. Musthave Babe is not responsible for packages that are marked as delivered according to the track & trace system.

 

Article 12 – Duration Transactions

For duration transactions, separate agreements apply regarding termination and renewal.

 

Article 13 – Termination and Renewal

Where applicable, legal rules regarding termination and renewal apply.

 

Article 14 – Payment

Payment must be made immediately upon placing the order using the available payment methods.

 

Article 15 – Logos and Trademarks

The use of the Musthave Babe logo or brand name without written permission is prohibited and may result in liability.

 

Article 16 – Complaints Procedure

Musthave Babe has a complaints procedure and handles complaints carefully. Complaints must be submitted within 7 days of discovery, clearly described and complete. Complaints will be handled within 14 days. If more time is required, the consumer will be informed.

 

Article 17 – Disputes

All agreements are exclusively governed by Dutch law. 

 

Article 18 – Privacy Statement

Musthave Babe treats personal data confidentially and does not share it with third parties, unless necessary for the execution of the agreement or to comply with legal obligations.

 

Article 19 – Additional or Deviating Provisions
Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing.

 

Article 20 – Return Conditions

Returns are possible within 14 days of receiving the product. Returns are made at the customer’s own risk. Musthave Babe is not liable for damaged or lost return shipments. Returned items must be unused, clean, and in their original packaging. Damaged or used items will not be accepted.
